of at least Twenty Five Thousand Dollars ($25,000.00).The Applicant must list all loan officers licensed to conduct business in Arkansas. A loan officer shall not be employed simultaneously by more than one (1) licensed mortgage banker or mortgage broker.Each mortgage banker and mortgage servicer is required to post a surety bond in the amount of One Hundred Thousand Dollars ($100,000.00) and each mortgage broker is required to post a surety bond in the amount of Fifty Thousand Dollars ($50,000.00). |

Title 6, Chapter 9, Article 2, 6.941In order to qualify for a mortgage banker license of such a license an applicant shall: 1. Have not fewer than three years' experience in the business of making mortgage banking loans or equivalent lending experience in a related business. If the applicant is a person other than a natural person, the responsible individual shall meet this requirement. 2. Have engaged or intend to engage in the business of making mortgage loans or mortgage banking loans. 3. Either: (a) Be authorized to do business with any of the following: (i) The federal housing administration.(ii) The veterans administration. (iii) The federal national mortgage association. (iv) The federal home loan mortgage corporation. (b) Notwithstanding paragraph 5, at all times have and maintain a net worth of not less than 250,000 dollars. 4. Provide the superintendent with a current audited financial statement or that of its parent company prepared by an independent certified public accountant in accordance with generally accepted accounting principles including: (a) The certified public accountant's opinion as to the fairness of the presentation in conformity with generally accepted accounting principles. (b) A balance sheet prepared within the previous six months and certified by the licensee. The superintendent may require a more recent balance sheet. (c) A statement of operations and retained earnings and a statement of changes in financial position provided the applicant has commenced operations. (d) Notes to the financial statement if applicable. 5. At all times have and maintain a net worth of not less than 100,000 dollars. Nonrefundable application fee. If the natural person is not a resident of this state, an employee of the licensee shall be designated in the license as the individual responsible for such licensee. A responsible individual shall be a resident of this state, shall be in active management of the activities of the licensee and shall have not less than three years' experience in the business of making mortgage banking loans or equivalent experience in a related business. Every person licensed as a mortgage banker shall deposit with the superintendent, before doing business as a mortgage banker, a bond executed by the licensee as principal and a surety company. |

Chapter 494, FL statutes Correspondent Mortgage Lender/A Correspondent Mortgage Lender is authorized to originate a mortgage loan and may close loans in the name of the licensee. However, they may not service a mortgage loan for others more than four months after it is closed. The licensee must be a lawfully formed entity such as a corporation , limited liability company or a partnership. Evidence of being a legally formed entity is required with each application.The licensee is required to maintain a minimum net worth of 25 thousand dollars and have annual audited financial statements in accordance to generally accepted accounting principals prepared by an independent Certified Public Accountant. In addition, a continuous surety bond of 10 thousand dollars is required to be issued of a forms available from the Department. The licensee is required to maintain and transact business from an office within the State of Florida. The application fee is $400. (See fingerprint card requirements below.) |

Qualified Foreign Lenders Should No Longer Register With DFI
Or With Any Other State Agency: During the 1999 Hawaii Legislative
Session, the State law relating to mortgage loans (Chapter 207,
Hawaii Revised Statutes ("HRS")) was amended by Act
43, Session Laws of Hawaii (1999), effective on April 26, 1999.
Sections 207-14 and 207-15, HRS, were repealed. As a result,
the exemptions and immunities described in Section 207-12, HRS,
are now accorded to qualified foreign lenders without the need
for registration of the foreign lender with DFI or with any other
state agency. Since neither DFI nor any other state agency is
authorized to interpret part II of Chapter 207, HRS, a lender
should consult an attorney if it is uncertain about any provision
there in Chapter 207, including whether it is a "foreign
lender" as defined in Section 207-11, HRS, or whether it
is entitled to the exemptions and immunities described in Section
207-12, HRS. The DFI cannot provide such legal advice and cannot
render an opinion or interpretation of any provision in Chapter
207, HRS.

MORTGAGE BROKER LICENSE A new law, the Mortgage Broker Licensure Act, was enacted effective November 1, 1997 (Okla. Stat. tit. 59 Section 2071 et seq.) which requires mortgage brokers to be licensed with the Commission on Consumer Credit.-A mortgage broker means any person who for compensation or gain (or in expectation of such) makes a residential mortgage loan or assists a person in obtaining or applying to obtain such loan (or holds himself out as being able to do such).-A residential mortgage loan is any loan primarily for personal, family or household use secured by a mortgage or residential real estate of a one- to four-unit family dwelling.(Okla. Stat. tit. 59 §2082) Exemption from Supervised Lender License: Lender making mortgage loans primarily secured by an interest in land, which is defined as a loan in which the collateral is substantial in relation to the amount of the loan, and the loan finance charge does not exceed 13 percent per year calculated according to the actuarial method on the unpaid balances of the principal on the assumption that the debt will be paid according to the agreed terms and will not be paid before the end of the agreed term, except if the loan is made subject to the UCCC by agreement. If not exempt, need license to make consumer loans at rates in excess of 10 percent (i.e., supervised loans). UCCC is not intended to apply to mortgage lenders. |

Non-profit organizations exempt under Section 501(C) of IRC using revolving loan funds when registered under Title 10, Section 690a.(8 V.S.A. §2200, 8 V.S.A. §2201) INITIAL APPLICATION Application for license must be in writing, under oath in the form prescribed by the Commissioner. -If the applicant is also to engage in mortgage brokerage, this must be included in the loan application. Lender must have and maintain $25,000 of liquid assets. (8 V.S.A. §2201, 8 V.S.A. §2202, 8 V.S.A. §2203, 8 V.S.A. §2208) The Commissioner must approve or deny an application within 60 days from the filing of the application with the fees and approved bond. (8 V.S.A. §2204) STATE FEES AND CHARGES $1,000 investigation fee. $1,000 initial license fee. $100 additional fee if lender also intends to engage in mortgage brokering. The actual costs of the Commissioner's examination of the licensee.(8 V.S.A. §2202, 8 V.S.A. §2222) $100 fee to change address of business.(8 V.S.A. §2208) Renewal fee of $1,200, except for a person with ten or more licensed locations, the renewal fee shall not exceed $12,000.(8 V.S.A. §2209) BOND An applicant must file a bond with the Commissioner in the amount that the Commissioner requires, but not less than $25,000.(8 V.S.A. §2203) The Commissioner may require the licensee to furnish one or more additional bonds if it finds that a licensees' fund is insecure, exhausted, insufficient, or otherwise doubtful.(8 V.S.A. §2207) MISCELLANEOUS The license must include: -The address at which the business is to be conducted.-The name of the licensee.-If the licensee is a partnership or association, the names of its members.-If the licensee is a corporation, the date and place of its incorporation. The license must be kept conspicuously posted in the place of business. A license is not transferable or assignable.(8 V.S.A. §2206) The licensee must have a separate license for each business location. The licensee must notify the Commissioner 30 days in advance in writing of a change in business address.(8 V.S.A. §2208) A licensee may not conduct any other business in the office where loans are made unless approved by the Commissioner.(8 V.S.A. §2227) A licensee may not transact business or make any loan under any other name or at any other place of business than that named in the license.(8 V.S.A. §2228) |

MORTGAGE LICENSING AND REGULATION Effective immediately, WV will no longer accept applications to conduct second mortgage activity in West Virginia. On July 1, 2000, all companies engaged in mortgage activity, regardless of lien position, in the State of West Virginia and not subject to a specific exemption under statute or not properly registered to conduct business in West Virginia by July 1, 2000 should apply for a license from the West Virginia Division of Banking (WVDOB). Companies properly registered to conduct business in West Virginia by the West Virginia Secretary of State and/or the West Virginia Department of Tax and Revenue by July 1, 2000 have until August 1, 2000 to submit a properly completed application to the WVDOB. Companies not in compliance with business registration requirements and who have not submitted a complete application should cease mortgage activity until the proper license has been obtained from the WVDOB. |
